ReplyDeleteIn criminal cases, one spouse may refuse to testify against his/her defendant spouse as a witness. As affirmed by the Supreme Court in Trammel v. United States (1980), the witness spouse alone may choose to waive the privilege, regardless of the defendant spouse's objection.
ReplyDeleteSo, Lori can waiver the privilege and testify even if husband objects.
To live together in holy marriage, to honor and hold, in sickness and health, richer and poorer.

That is if Lori is used as a witness against her husband if she were to strike a deal.

ReplyDeleteYeah Sandy, my knowledge of American law is worse than Enty's, but if Law and Order:SVU has taught me anything (apart from Mariska Hargitay's inability to move her facial muscles) then it's that a wife can voluntarily testify against her husband, but cannot be forced to do so. She will face no legal sanctions that would apply in any other circumstance.

ReplyDeleteMaybe if it was her husband's name on the CHECK which would constitute the actual wire fraud (aka the long prison sentences)and not the conspiracy to commit wire fraud (I forget all her charges) , Lori could make a plea deal and in agreement testify against her husband.
Doubt this is going to happen though.....
Lock them both up, along with their shitforbrains daughters.
ReplyDeleteMakes no difference what she pleas now. I have lost all respect for her and the actions and arrogance of her and her daughter disgust me. T least her husband knew to keep his mouth shut. Her career should be done done and done. And she should get a huge fine and serve jail time. Sorry but I just don’t feel the same about felicity Huffman who admitted guilt, cooperated and I believe is actually repentant and mortified. LL, NO.
ReplyDeleteThe prosecutors made it clear no jail time, no deal. Especially now since she snubbed the first offer. There won't be a second. I still think everyone will go to Club Fed with Bernie Madoff. The fact that Lori is dragging it out is making it just worse for herself.
