Today's Blind Items - The Will
A phone call was made to an attorney. The attorney was rumored to have prepared a will in the year prior to the death of this A list rocker. The will was substantially different from one prepared about a decade earlier. Offspring were provided for and no one else. When the call was made to the attorney by an ex of the rocker, the attorney remembered preparing the will, but for some reason had not retained a copy as was his custom. He had billing records showing he prepared an original and delivered it with, three copies to family, but for some reason never filed his won copy.
This was discovered after months of looking by the attorney through all files of all clients. Why would the attorney have to search? Because the family member who was given the copies said no such will existed. The family member claimed the rocker hated it and destroyed the original and copies and wanted his previous will to remain in place. Without any proof that the new will was desired, the much older will remained in effect.
The older will was not the intent of the rocker. It left off offspring which he wanted to rectify. The thing is though, that was never going to happen as long as someone else had control of all documents and is super greedy. The ex is doing everything they can to fight for not only herself, but also her offspring. She is being fought every step of the way. The greed is strong.

ReplyDeleteThe law firm didn't scan a copy of the will? That's been common practice for over 15 years. Even if someone tried to delete the PDF, it would still be on their back-up server & they would have the meta-data.
ReplyDeleteTrying to make this sound like Cornell, but why would the ex be fighting for herself and the offspring? I haven't heard of Chris having a will filed. If it was,it would be in the public record. I think this has to do with the child support Chester Bennington owed,and whether provisions were dealt with regarding that.

ReplyDeleteGeez! I never even considered it possible that the attorney wouldn't have a copy of the will! Then again, with stories like Aretha and Prince, I'm stunned that a person with any sort of assets/legacy would not have a will at all. Also, would think these celebs would have trusts established to avoid public probate.
ReplyDeleteSeems almost too obvious to be Chris and Vicky. So, she would have destroyed the revised will that only divided amongst the three kids? Can't imagine he ever would have had a will that excluded Lily. Chester's wife didn't seem like Vicky, but could this be them, as I think his past might be even more complicated? Tom Petty's family definitely has some drama going on, but I didn't think their situation fit as well.

Maybe somebody who benefits from the old will paid off the attorney to "lose" his copies of the new will.

The only people that win in will/probate fights are the lawyers who eat up the estate in legal bills. Be fair split it and move on with your life.
Also if he had an irrevocable trust and only Dana is named. There is really nothing the daughters can do about it.

ReplyDeleteMake sure your paperwork is in order folks! Wills, medical/healthcare decisions for treatment/end of life, who can speak for you when you can't speak for yourself, financial power of attorneys, etc. Who knows where all your financial paperwork is? Password list? Safety deposit box keys and locations of said boxes. Who's going to toss your sex toys so your mother/children don't find them?

ReplyDeletePlease bear with me, and correct mistakes in thought...
1) Will of 10 years ago (#1) left out one or more children
2) Revised will (#2) included children, but not spouse or ex
3) Three or four copies of #2 were delivered to rocker(?)... Says family, but I am not familiar with others getting copies of someone's will before death, so assuming delivered to rocker at family home? Especially in case of Cornell, all three children were minors, so copies of anything legal to guardian.
4) Somehow, #1 must have been brought and read as Will of record, right? Otherwise, ex would have no clue of her and offspring being overlooked. Rocker must have spoken to someone about correcting a past wrong by updating with #2. Having heard of this, Ex went to attorney asking about #2.
5) This is where I really hit a wall...after months of searching, atty has to resort to calling the widow to ask, "Hey, in going through rocker's papers, did you happen to find a few copies of a more recent will that would be less advantageous to you and your children? Bc his ex and offspring know about it and need it enforced, but it cant find it." That would be hugely embarrassing for atty, BUT, UNTIL THAT MOMENT, UNLESS conspiring with the atty from start, there is no way widow could have plotted anything regarding the wills, right? I think most would assume that the atty would have a copy of the most recent signed will, so nothing shifty could be done.
SO...either widow is a Grade A schemer and "bought off" lawyer to lose #2 (and the months of hunting and excuses are smoke and mirrors lip service to the ex and offspring), OR, widow is a Grade A think-on-her-feet con who saw $ signs dancing in her eyes when she figured out that no copies of #2 existed outside of her possession. Even if she torches those copies, she'd still run the risk of a copy turning up or forensic techs being able to retrieve something at some point, unless, again, conspiring with the atty.
Horrible to think that in any of these cases, the person is opting for greed over the deceased's other offspring, who are her children's half-siblings.
Ok, I was reading family member in possession of the wills as current wife/widow (not necessarily vicky the widow, which was a great point made by someone).... But could be a family member of any kind...

Talinda Bennington. Remember she asked for another year to work on Chester’s Estate? And she has a horrible relationship with his ex and his son Drevor. THE ex believes that both SHE and HER SON are entitled to money from the estate.
ReplyDeleteSusan Silver doesn’t believe that she’s entitled to anything (she already got her settlement in their divorce, including rights to 1/2 of Chris’ catalogue.) She’s only worried about Lily, not herself.
