Blind Item #11

Just like I told you in the past week or so, prosecutors are going to try and make a case against the former A+ list singer without using the victim from the child porn tape. They are afraid of double jeopardy and losing the entire case.

  2. that is not double jeopardy if it's a different victim.

    he cannot be convicted on the ORIGINAL charge that he was acquitted of. if this is a different victim, it's a new charge and therefore has nothing to do with double jeopardy.

    Foxx compared Smollett’s case to her office’s pending indictments against R&B singer R. Kelly in text messages to Joseph Magats, her top assistant, on March 8, the paper reported

    “Pedophile with 4 victims 10 counts. Washed up celeb who lied to cops, 16 (counts),” she wrote. “… Just because we can charge something doesn’t mean we should.”

  9. It's not double jeopardy that would cause the tape of the previous victim to be withheld, it's that evidence of the prior bad act would cause a bias against Kelly in the jury and therefore would deny him a fair trial. I just watch an unholy amount of Law and Order and I'm correcting Enty?
