Blind Item #4

He could have kicked in some money, but instead this former A+ lister sent out press releases to the world to make it seem like he was making charitable donations when he wasn't.

    It's meant to be Johnny but it's dumb. The press release explicitly says it's in Amber's name so I'm not sure how he's trying to take credit but whatever.

    The press releases **clearly** state and it's been reported EVERYWHERE that he's making the payments he owes Heard DIRECTLY to the charities she mentioned. Depp Rep:
    "Following Amber Heard's announcement that her divorce settlement was to be divided equally and gifted to Children's Hospital of Los Angeles and the American Civil Liberties Union, two exceptionally deserving and important charities, Johnny Depp has sent the first of multiple installments of those monies to each charity in the name of Amber Heard, which when completed will honor the full amount of Ms. Heard's pledge."
    I understand you're being a douche about this, but making shit up is annoying AF. GTFOver it.

    So it did occur to me that even thought Amber Heard said she will be giving the money to the charities, how would we ever know she really did give them the money? So I think that Depp is kinda sticking it to her by giving the money directly to said charities. At least now we know they really are going there.

    Call me cynical but I'm wondering about a possible tax angle. Divorce settlements are generally tax free to the receiver and therefore AM would not pay taxes on the $7MM. If AM subsequently contributed the money to registered charities she would receive a tax deduction for the $7MM charitable contribution. Given her current earning power it is unlikely that she would be able to fully utilize that deduction on her tax return in the near future. However the press release says that JD is making a donation in the name of AH. This strongly implies that JD is getting the tax deduction (and presumably has the earnings power to utilize it). For a parallel consider what happens when a friend dies and the family asks for donations to a specified charity. You make the donation in the name of the deceased person (In Memory Of ....) but the charity issues the tax receipt in your name.

  9. Amber must have read up on her art of war. It was never about money, it was about career advancement. She used to be a extraordinarily pretty struggling actress, and now she's a star. I think she always intended to give that money away as a mic drop to end the gold digger conversation, which it for the most part did, and maybe there is some element of, I don't want a single cent from you, and I don't need it. You'll note the breakup happened once she was securely part of the Marvel family.

    You're absolutely right--there's nooooo question that's why he's paying it this way...making it so she has no choice in putting money where her mouth is ,so to speak..(also it's not as painful for him knowing he's giving his money to charity & not to her)

    They can work the divorce settlement to allow for Amber to claim the tax deduction if that was agreed upon.Any thorough Divorce Settlement addresses who gets what Tax deductions & credits & adjustments,etc.---they worked that all out.

    She isn't part of the Marvel family, she is part of the DC family and that is a whole different ball game. DC is staggering from one critical flop to another. Her side shoot, as Aquaman's squeeze, comes with the lowest expectations of all the DC films. It is also the one least likely to pull in an audience, no matter how good it is.

    To Enty,Depp is well-known for his donations and visits to this and other Children's Hospitals. Many times they were reported, many times not,but a quick Google search would help you with that. He also donated a large amount of money to the Hospital that treated his daughter when she nearly died. I'm sure there are other nasty blinds you can write about Johnny, but this shouldn't be one of them. If you need to help Amber, write something positive about her.

    Lawyers are pretty specific to their practices. In other words, a divorce attorney will not be an expert in tax related legal advice or an entertainment lawyer is not going to be an expert in other practices of law. And then States legal statutes throw another bunch of crap people have to deal with. Depp and Heard are following a very specific procedure.

    Personally I think the blind is referring to Trump who said he was going to donate to Louisiana Flood relief. Not gonna happen unless the Washington Post shames him again.

    You're not wrong, this was just posted on TMZ:

    Amber Heard has just fired back at Johnny Depp, saying if he really cares about donating Amber's divorce settlement he'll ante up $14 million, not $7 mil ... and in fact she's insisting on that.

    Amber's team tells TMZ, Johnny is not being up-front about his latest move ... giving Children's Hospital of L.A. and the ACLU the $7 million earmarked for Amber.

    Amber said last week she would donate the settlement money to the 2 charities, but her people tell us if Johnny sends the money directly to the 2 organizations he's not really paying $7 mil, because he gets a charitable tax deduction.

    And we're told Amber's position is that the money is not Johnny's to give away.

    Amber's people tell TMZ, "If Johnny wishes to change the settlement agreement, we must insist that he honor the full amount by donating $14M to charity, which after accounting for his tax deduction, is equal to his $7M payment obligation to Amber."

    The team goes on ... "We would also insist that the full amount be paid immediately and not drawn out over many years."

    They blast Johnny's team, saying, "Anything less would be a transparent attempt by Johnny's counsel, Laura Wasser and Patti Glaser, to reduce their client's true payment by half under the guise of newfound concern for charities that he has never previously supported."

    Actually JD could end up paying twice. Usually settlements are put into a lawyers trust fund and disbursed from there according to the settlement agreement. If the agreement calls for $7MM to AH and the $7MM was paid directly to the charities then someone still owes AH $7MM. Either JD (i.e. he paid charities when the settlement called for him to pay AH) or his lawyers if they screwed up the disbursement (i.e. the lawyers didn't have a document signed by JD/AH authorizing them to pay charities directly).

  26. Bottom line, it's HER settlement from Depp. Once he delivers it to her, she can donate it, she can keep it, she can say she's donating it and still keep it in the end. Regardless, Depp owes the $7M to her, not any charity; once she receives it from him, then its hers to do with whatever she wishes. Hope her lawyer nails Depp to the wall on this. His deal is with her, not whichever charities she may or may not then donate her settlement from him to.

    Amber, Amber, Amber. You almost turned this PR mess around for yourself (at least partially). Notice it's her "people" making statements, not her lawyers. Perhaps they'll weigh in, but they haven't yet. Depp was given an honor by the Children's hospital designated, for his past charity contributions, so he's being true to his character in that regard at least. Both charities stated they've already received checks from him (although they're partial payments). Interestingly, Amber picked two charities that have what's known as charitible annuities. Basically, you donate funds, and receive a payment for life, and a tax deduction. She'll still receive a tax deduction, however it's set up, because it's donated in her name (which he can do as her still legal husband). Pretty sure she's mad that he intends to donate the entire amount, though...as the charities themselves would never reveal amounts without permission. Oh, Amber, it certainly does seem like it's about the money if you don't let these donations go through this way. Otherwise, it's not him that appears deceitful, it's Amber. He IS donating the money, if that really was her intent, so what's left to be mad about?     Agree that's likely the law in this case depending on how the agreement's worded, but her attorney's haven't commented, only her other reps. It might be worth it to Depp to show that she was being manipulative about charity donation of all of it -- he has 14 million to spare if it comes to that. Not sure he's going to look like the crazy one here...and it does make Amber look more like it WAS about the money all along. I commented below about those two charities in particular.

    I think there is big cash money on the side, and this 7 mil is just PR money to clean up their images...I think though that they know Amber wants to dip in it, so that all the clean up and the extra change and benefits go to her.

    This isn't about who gets the tax deduction or how she was going to spend the money, the real issue here is how controlling this seems. Whether he likes it or not, a divorce settlement is a divorce settlement, and that money becomes the partner's. It's not his place to spend it for her, regardless of what she said she would do with it.

    Imagine if this were any other divorcing couple, how would it seem?
