Today's Blind Items - Not His Baby

He doesn't know that he is not the one who got his wife pregnant. Sure, they never really had much sex before she got pregnant, and yes, she always made him wear condoms, and the reason is simple. His wife, an A list mostly movie actress is pregnant, but she used the sperm of her last boyfriend. She really wanted to marry him and have his babies and thought she could be one of the biggest stars in the world, especially if they were a couple. Our actress has a little stalker in her and a little crazy and when you combine that with her drinking issues, she is a piece of work. The previous boyfriend is an actor and has no idea that our actress managed to save some of his sperm. This was something she planned the entire time they were dating just in case he did leave her or if he stayed, if he didn't want a baby. The husband doesn't look dramatically different from the actor but he is going to be in for a world of shock if the couple ever get divorced and he tries to get child support from the actress.

    3. Not very likely. You can't freeze sperm in a home freezer. It has to go into liquid nitrogen immediately to be saved.
      I seriously doubt the truthfulness of this blind!

  35. I read snippets of Zoe's recent interviews and there seems to be a lot of shade thrown at Bradley. I don't recall much in the way of quotes about marital bliss, but there are some dispersions being cast at the ex for sure.

  55. Well, it kind of doesn't matter. They are married. Since it doesn't say foreign born, chances are they live in California. He's the putative father. The fact that he's not bio dad only matters depending on length of relationship and age of child at any potential future divorce/custody/child support proceedings.

    US Supreme Court case law on this issue.

  57. Kara's got it. In CA, the hubby becomes the permanent legal father of any children born in wedlock two years after the birth. The hubby could get CS from her, but that's also the deadline for the mom getting CS from the bio. dad. If someone is crazy enough to do this, she'd know about the two-year deadline.

  59. So, here's the weird thing. I saw a story once about a guy who was married, they had a child which he thought was his biological child, got divorced, he had been paying child support for years. He remarries, eventually new wife meets both old wife and kid, and new wife figures something out. Both he and old wife have blue eyes but the kid has brown eyes.

    Basically, not possible. I mean in VERY rare cases, it's possible, but if you see two blue-eyed parents with a brown-eyed child either that child is adopted or mommy cheated.

    So, he gets the DNA test done, it's not his kid, he sues to terminate child support, and guess what.

    He's on the hook until the kid is 18 because he's the legal father - name on birth certificate, married at time of birth.

    No law says you can go after the biological father or sue the mother for fraud.

    It's all about the "welfare of the child" which trumps this guy's rights.

  60. Besides, by law, the legal "father" is whatever man signs the birth certificate. Toss into that actually being the one who RAISES said child as he was completely deceived about paternity and...whoever this actress is (if it's true) is in for a whole WORLD of serious legal and financial trouble on all fronts if the truth is ever revealed. And if biological baby daddy catches on, demands a test and is able to prove that a child was conceived against his will using his uh, material, months or years after his last physical contact with the mother??? Girlfriend would be facing jail time and very rightly so. Jesus in Heaven what is wrong with people?!?

    He's on the hook because he WAS the legal father. If mom cheated, that's one thing, but he was the child's father, even if name only, and presumably shared custody. "New wife" is apparently smarter than her new husband, and needed a DNA test to prove that he shouldn't have to pay for the "welfare of a child". Because taking care of the child who has called you Daddy her entire life is a terrible thing.

    She may be very selective about who she exposes, but I've found her blind riddles to be reliable.
    As to whether he's gay or bi, only he (and perhaps his therapist) can say.

    New wife's instincts were correct.

    I understand the public interest argument for having the "legal" father on the hook for 18 years of child support. I don't happen to agree with it.

    At the time he found out he was not the biological father the child was under 2 years old. Not likely to be traumatized for life if he dropped out of the picture.

    And what about the rights of the biological father, who likely doesn't even know he has a child?

    And what about the rights of the child to know his biological father?

    As for the biological mother facing jail time - I believe any legal action would be civil, not criminal.

    No, wrong. The father listed on the birth certificate is the putative legal father. That status can be challenged for two years after birth (in CA, think it's the same in most states). My name isn't on my son's birth certificate, but I am his legal father. BC is kind of irrelevant.

    Please, people, I've had to spend tens of thousands of dollars wrangling over a paternity and CS suit. I know what I'm talking about.

  66. @B Profane, I'm curious about your story. Care to share?

    Also, everyone should be aware that family law varies from state to state, and definitely from country to country. So what you post may be true in YOUR state but not in some other CDANer's state.

    The saddest case I ever read about, and it also made me incredibly angry, was the case of a man whose girlfriend or wife decided to give up their baby for adoption. To the best of my recollection, they got pregnant together and were going to raise the child together but she changed her mind and didn't tell him.

    I think this was in NY state. So she goes off, has the baby, disappears without warning within a day or two of the birth (with lots of help from family and some Utah-based adoption counselor) ... signs over the baby to this Utah guy and off the baby goes to Utah.

    Now, it took the baby's father a while to figure out what had happened. I mean, he was on it from Day One but she wasn't making it easy for him.

    Eventually he finds out that his baby has been taken to Utah.

    Well, Utah has the most liberal adoption laws in the nation. It's practically a haven for adoption mills.

    Turns out that by Utah law, he had a very short time period to appear in a Utah court and assert his paternal rights. I want to say 10 days. Maybe 30.

    He didn't meet that deadline because it took him longer than that to track down his child.

    So he was SOL.

    He wasn't high income, but he got a lawyer, and he fought as hard as he could ... but the Utah courts (that are very cozy with the adoption mills) turned him down at every point.

    If it can happen to a father who very much wanted his child from before its birth and never signed a document or gave up his legal rights ... we should all be VERY afraid.

    I saw a news story on this a few years ago, am going from faulty memory on the details ... will try to find a link and post it here.

    Also, I'm no fertility specialist, but I bet you could use sperm from a used condom to get pregnant if you are a fertile Myrtle and your timing is good. Wouldn't have to even freeze it if you were ovulating and he is a hit and run kind of guy.

  74. My particular story isn't that interesting, but I did have reason to consider about confirming paternity via test since the pregnancy was so unlikely. But when our son went from being a baby (by which point he'd already bonded with me) to a toddler, he developed into a little Xerox of me at the same age, so I never bothered.

    Paternity and family law laws do vary from state to state but not as much as they used to. The law is pretty much the same in all the high-population states so you can usually go by what the law is in California. Almost all celebrities legally reside in CA or NY anyway.

    In the case you cite, the father probably could have gotten the adoption undone in a New York court. In CA, in a case like that, the mother has to swear that she doesn't know who the father is in order for the adoption to be finalized. Otherwise the father has to specifically renounce his parental rights. Doesn't matter what the UT law is, the law in the state in which the adoption happened is what matters and a fraudulent adoption could be undone.

  75. @B. Profane, that father hired lawyers and couldn't get his kid back. The kid was taken to Utah and the mother surrendered her parental rights there. If you clicked through to the story I linked to, Utah law is INCREDIBLY anti-father. One line I read explained it. It's a very Mormon state, as you know, and apparently in Mormon culture if the parents break up, they think it is better for the child to be surrendered for adoption into a two-parent family than to be raised by a single parent. So they allow a woman to surrender a child unilaterally, the father doesn't have to sign the surrender papers or even be informed about the surrender, and the father has an incredibly short amount of time to contest before he loses all rights in the state. I read in one article that it's something like 24 hours to file a response in court, and there was actually a case in which the child was born on a weekend and the courts weren't even open, so the father went down on Monday to file his objection and was told he was SOL because the 24 hours had expired. That's how bad it is in Utah.

    And, whatever the circumstances of the case I cited, Utah law is what controlled. Even if the mother deceived the father and moved the child from the birth state to Utah.

    It's fucked. But apparently it's how the law works. So if you want to screw your partner out of his legal right to his own child ... just give birth in Utah or get yourself to Utah ASAP after the birth.

  76. Re: "whichever man signs the birth certificate is the legal father"...I have 4 kids. 2 born in CA, 2 born in NV. there was never a paternity question in any birth, and I was/am always married. But, each time, I WAS the one filling out the birth certificate info, and the ONLY parental signature on each of my 4 childrens' birth certificates, was MINE. It was the very same process in both states, in all 4 births. Just fyi!

  81. This scenario may be slightly plausible IF, prior to separating, the ex had some of his baby batter stored at a sperm bank, the relationship's ended, and she's used it (most likely without his consent, as legally it is still his 'property').
