Yesterday in a New Jersey courtroom, the truck driver charged in the accident which left one person dead and four others injured, including Tracy Morgan, pleaded not guilty to one count of homicide by auto and four counts of assault by auto. Kevin Roper was driving a truck for Wal-Mart and had been up for 24 hours straight when he dozed off and failed to notice traffic had stopped in front of him. His semi hit the limo bus carrying Morgan and others and the bus flipped over, killing one and injuring four. Roper didn't say anything in or out of court which marked a change from his Tweets which said he was only charged after police discovered one of the injured was Tracy Morgan and that he was being treated unfairly because Morgan is a celebrity.
Depends on the circumstances I guess. It is sorta true though---look at Brandy she got away with murder. So it will be interesting to see when the roles are reversed.....
ReplyDeleteMy relative had an accident where they fell asleep and the other person in the car died. They said it could've been a mini stroke and they don't remember anything about it. They were not arrested and ended up with a ticket and a fine. Not saying this guy shouldn't be punished, but there are always two sides.

ReplyDeleteHe also said (on Twitter, I think) that he never told the police he hadn't slept in 24 hours. He said that's just not true, and he was being thrown under the bus (media wise as well) because of Tracey Morgan.
That wouldn't surprise me.
Sounds like some Wal-Mart is getting ready to battle instead of taking responsibility.

ReplyDeleteI remember a few years back a truck driver rammed into the back of a minivan, which was full of children since they were coming home from school. To make matters worse, the van was stopped behind a school bus. Everyone in the minivan died, while kids on the bus watched. The trucker admitted to being pressured to drive over 24 hours straight in order to make a deadline, he fell asleep.
ReplyDeletePoor guy. I feel sorry for him and I don't. They used to try to get me to stay at work forever. I would call it quits before 18 hours so I could drive. They didn't like that at all. I know all drivers are supposed to have time records. Businesses aren't supposed to keep them on the road for 24 hours. He should have used better judgement. You only get one life.
ReplyDeleteBecause they are the low price leader, their goods must be delivered 'on time' regardless of whether the driver gets enough sleep or not -- or whether some one dies in an accident.

ReplyDeleteI realize that there are some strong haters of WalMart out there, but the fact is that this guy just as easily could have been working for any number of LTL carriers. The realities of modern logistics cut the amount of wiggle room down significantly. I can only imagine the firestorm of outrage if his trailer was revealed to have been loaded with the newest Bill O'Reilly book .-)

Please don't throw around the term "murder" unless you completely understand the legal definition, which if you did, you would know that this is not "murder" at all. It is vehicular homicide and he will only be convicted if found negligent beyond a shadow of doubt.
ReplyDeleteNot beyond a shadow of a doubt (I wish), but beyond a REASONABLE doubt. And negligence is a pretty low bar as opposed to intentional or knowingly.
ReplyDeleteAnyhoo - He's probably not totally wrong. Who the victim is and who the defendant is plays into charging decisions a lot, unfortunately. Even when you try not to let it. The dirt bag meth dealer dies? Meh. The prominent citizen is behind the wheel? Yikes. All the sudden we have compassion and understanding!
The guy still rear ended a bus...so whether or not he was on a no sleep for 24 hours thing or not....he hit people and killed someone.

DeleteDerek - that would have been the first thing the cops checked for so doubt if he was because that would be the headline. Texting accidents are killing/injuring more than drunk drivers at this point. He should keep his mouth shut but think he will get tougher treatment because celeb injured and maybe even because he worked for Walmart (and doesn't everyone except for the millions of customers that need to shop and save $$ there hate them.)

ReplyDeleteWalmart is a highly coveted position for drivers. There is a 6 month to a year waiting list just for an interview. All of their log books are digital as opposed to paper (they can't be forged. The truck logs your driving, the law dictates your time driving/resting). That's not to say the driver didn't park at a casino, party all night, and then hit the road. But this one is probably NOT due to Walmart policies.
Guntotin' TxMama - please dont' go throwing facts and logic into this. Celebs and unions tell us that walmart is bad- that is all most need to hate walmart (except those that need to buy something at a great price.)
