A man in Florida has been charged with criminal transmission of HIV, battery, false imprisonment, two counts of arson, two counts of aggravated battery and sexual assault after he doused his girlfriend with gasoline on Halloween night and forced her to have unprotected sex with him. He told her during the assault that she was going to die one way or the other. He says that she was cheating on him which is what made him do it. During the assault the man also doused the kitchen table with gasoline and set it on fire. She says he would not let her leave even though he had covered her in gasoline.
She managed to free herself and got out of the house.
So, where's the attempted murder charge?

Fl lawyer here. Intentionally having unprotected sex w someone if you are HIV positive can be grounds for attempted murder charges but I haven't seen it outside the bar exam.

ReplyDeleteI think he doused her in the gas to try and prevent her from catching the Hi 5. Very caring gesture on his part. They have found an anti fungal foot cream aids (heh) in blocking transmission, so who knows what other home remedies are out there.

ReplyDeleteAs a general rule, you have to be black in order to be prosecuted for HIV transmission. As I've pointed out before, here and on other discussion boards.

DeleteI'm sure most of y'all are more liberal in the area of things like the death penalty than me, but I'd bring back some of those Old Testament style punishments. Heck, I'd like to see a town square guillotine, stretching racks, bed of nails, etc.
