DEA Forgets About College Student In Cell For 5 Days
Yesterday when I read about Daniel Chong I could not believe a law enforcement agency could not remember putting someone in a cell 5 days earlier and then forgetting about him. When I heard the initial statement on the issue I was even more ticked off. If you forget someone and they have to drink their urine to survive and try to kill themselves because they think no one is ever coming to rescue them, the statement you should make is "We are sorry." That's it. Nothing else. Instead, the DEA spokesperson originally stated that since Daniel was arrested at a party getting high, that he kind of deserved it. Seriously? He was never even charged with anything. Luckily the head of the San Diego DEA office issued a much better apology and when the DEA is forced to spend millions of dollars in compensation, and several people get fired, then perhaps a lesson will be learned.

In the first article I read about it, it said he did meth found in the cell! I spent so much time wondering how the hell that happened, but in all the subsequent articles, I see no mention of that.
ReplyDeleteI think the way this poor kid tried to kill himself makes it even more horrifying. Breaking his eyeglasses and using the shards of his lenses?? Good lord, how desperate could he have been? Hope he gets every penny of the $20mil.
Um, the real Enty would have noted that, due to sovereign immunity, the poor kid won't even clear seven-figures in the eventual settlement.
ReplyDeleteIn cases of LEO misconduct like these, 10X damages and mandatory jail time should be the legal standard. The badge is not a shield FROM the populace, it's a shield FOR the people.
B. Profane, do you claim to be a lawyer? I thought when you said you were "in the biz" you meant the entertainment industry.
ReplyDeleteThere are obviously ways around sovereign immunity. This isn't my area of law at all, so I won't claim to be an expert (and any lawyer worth his or her salt would never claim to know all areas of law) but the Federal Tort Claims Act may be invoked here, depending on what claim is used. It doesn't look like a tort on its face but there are surely more details there. And there are other methods of getting around sovereign immunity as well. I don't practice federal law but states and municipalities have their own versions of special courts that handle suits against them. In all likelihood there will be a settlement though.
This is so reprehensible. I can't imagine what that poor kid was experiencing in those days.

Seaward in one of the articles linked he mentions finding a white powder in the cell and ingesting it to survive. Unbelievable what he went through.

ReplyDeleteyou might remember someone named rodney king? he was beaten by la police and it was videotaped? the police wanted to settle for $1.75 million and he said no and went to trial and was awarded $3.8 million by the jury. and that was almost 20 years ago. so, apparently you're not as up on sovereign immunity as you might think.
The treatment of this boy is completely inexcusable and indefensible. It doesn't matter whether he was high or not at a party. If he was suspected of a crime, charge and process him.

@LeeLee--I am not an attorney, and I would defer to your opinion as an actual one. My understanding of FCTA and relevant case law is that it just flipped up a corner on the blanket of Federal sovereign immunity. You would probably know better.

@annabella and Cindy--Come on, now, sovereign immunity has everything to do with this kid getting damages in a tort action. Rodney King was a state law case, not Fed, and, as I recall, plaintiffs jury-shopped well. The RK case spawned Watts-scale rioting in a major city, it's no surprise that he got a good judgement. That doesn't mean that this kid will.

Enty may be a lawyer or may claim to be one, but he's certainly never claimed this is a legal blog. I'd recommend the volokh conspiracy for a well written legal blog if you can handle the strong Libertarian leaning of the contributors.

ReplyDeleteB Profane, of COURSE there would be a habeus case if anyone KNEW he was jailed. But if the authorities KNEW he was jailed he would have been released. It's a little difficult to bring a habeus claim when no one is aware there even is a prisoner.

"Enty" claims that all of the content of this blog, with identified exceptions, are written by him. No lawyer who has ever practiced in these 50 states would say a word about what supposedly happened to this kid without citing habeas or, with regard to him getting damages for his tort, sovereign immunity.

Did you read any of the articles linked here? The authorities are NOT claiming they had a right to hold this young man. They're saying they forgot about him.
ReplyDeleteAnd you're wrong about your analysis of the law. You hate Enty, I get it, and he's certainly said many things that are wrong when it comes to the law. But you acting as though lawyers don't misunderstand the law, especially areas of the law they don't practice, is ludicrous. Lawyers become specialized fairly quickly, and if you're not a civil litigator, your knowledge of civil litigation will generally be limited to what you learned as a 1L however many years ago. If you want to discredit Enty's persona, which you very clearly do, this isn't the best way to go about it.

ReplyDeleteYes, I think I understand the application of habeas better than you, since you are definitely not an attorney. I heard about the application of habeas in Federal court over the breakfast table--literally for years--from plaintiff's counsel who was working on a landmark habeas case in CA.

Another attorney checking in--and I'm admitted to practice in 2 of our 50 states. The point of a habeas action is to obtain the release of a prisoner. The student is no longer imprisoned ergo not a habeas case.

ReplyDeleteI'll jump in as a practicing criminal defense attorney. I'm also licensed in a couple states, like someone else above.
- It was impossible for him to file a habeas. He didn't have a lawyer at the time, he had no access to WATER so he didn't have access to materials to write a legal memorandum, and no one knew he was there to file one on his behalf.
- I'm not suspicious that he was held for five days and "forgot", but I am suspicious about his whole story of "finding" meth in the cell and being so desperate for food that he ingested the white powder to survive. I think he just wanted to explain any drugs in his system so they wouldn't be used to defeat his claim or discredit him in some manner.
- He was at a 420 party. Is a pot smoking party really something to do a raid on in California? Seriously? Just wondering.
- Tort claims against entities such as the DEA are difficult, but not impossible. Throwing around figures like 2 or 3 million for this kid, if his story is believed, is not unreasonable. I've seen it happen. Rarely, but it can happen.
My two cents.
Not a tort lawyer, though I've handled lawsuits. I am an expert in criminal law. At least I hope I am. If I'm not, my clients are screwed. :)
It's always the cover-up that gets them, the lame apology, the rats running for cover. If the DEA came out and said, Yeah, we screwed up very badly, we fired the person(s) [identified] responsible, and we're incredibly fortunate this kid lived, then this issue would go away and civil penalties would be much reduced. But no, they have to blame the victim and cover their asses. Invitation to a lawsuit.

ReplyDeleteI've seen city police get sued in federal court and the last case I watched the plaintiff was awarded $300k from the city and city police. And he was found to have contributorily negligent himself.

This "kid" was 23, not 17. That's a bit old to "experiment" with drugs. This society is going to collapse until we adopt better breeding practices. Elected officials, such as senators, should have better things to do.
Government entities get lower verdicts in general.

But clearly some ghosties have their panties in knots, likely because they recognize my writing style from another gossip venue where I broke down some of Enty's BI's rather ruthlessly. Get a grip. And, BTW, "LeeLee"? Go back and read the original CDAN posting about the Russell Brand/Katy Perry divorce settlement. "CDAN" claimed that Brand was gonna soak Perry in the settlement. I called bull, citing actual community property settlement practice in CA. CDAN, in a later posting, noted that Brand settled for essentially nothing.
So...CDAN itself validated my understanding of the relevant CA family code.
The poor kid deserves some compensation, so I hope he gets it. But that money is in no way a "punishment" for the DEA, who is just passing along additional tax dollars.

Well, there was something like 18,000 ecstasy pills, lots of illegal guns, and ammo in the house. So I assume the DEA knew about that and that's the reason for the raid. Timing it to coincide with 420, though, makes me think they were hoping to round up as many people as possible.
DeleteSupposedly the guy at the center of this was only smoking pot and didn't know anything about the other stuff. I totally believe that. I was once at a close friend's house, who I knew dealt pot. All of a sudden he said, "Wanna see something cool?" And showed me bricks upon bricks of fucking HEROIN stashed in his stereo. I NEVER would have expected him to be involved with that shit.
Although, I don't agree with discrediting LeeLee as a lawyer, I've enjoyed B. Profane's comments and he is certainly not a troll. All the long timers can attest to how much this blog has changed and I've enjoyed the differing theories. I mean look at the weird article in the NY Times!

ReplyDeleteMy original point was just that, IF the poor kid's story is legit (and it does smell a bit, yes?), the LEO's who cuffed up him up should be in theory liable for kidnapping and abuse under the color of law, even if due to just plain negligence. And there oughta be much higher standard of tort damages in such cases for the sake of sovereign deterrence.
I've been on both sides of the fence with LEO's. Hell, I dated a nice lady whose sister was a G-girl. I had a couple of dates with a very pretty prosecutor who admitted over the soup that she could pretty much railroad anyone into a plea bargain for anything less than a murder pop. One of my other ex's was a PD whose whole job was, more or less, keeping insane defendants from getting railroaded into plea'ing out for felony convictions. I know and have known a whole shit-ton of ADA's, criminal defense attorneys, LEO's and attorneys very tightly connected to the actual making of criminal law in one of the biggest states in the US.
You want to know the truth about prosecutorial misconduct and sovereign immunity? Ask a former LEO who gets a law degree and goes into death-penalty defense. Mega-overkill for rep'ing you in getting a bogus bar scuffle beef dismissed, but you'll hear stories...
So, yeah, I would totally give the scutty side-eye to some federal regs atty. lecturing me about applicable statutes or case law regarding sovereign immunity or habeas in re. LEO's. If such a person actually exists who can both earn a law degree and still misspell "habeas" two different ways.
This story should scare the hell out of any US citizen who values his or her civil rights. I'm sure this is not a completely isolated incident. Serial killers are treated better. The DEA is comprised of bumbling fools. legalize.

I don't particularly care if Enty is a lawyer or not, or a woman or a man. But B made some ludicrous statements about how "every lawyer in the US" would have written this article (for an entertainment blog) and continues to insult me personally. From the start I said I wasn't a litigator, and both Kara's and Unknown's comments back me up on my original statements, but I don't have the energy that B does to continue this fight. If she wants to continue to insult me, and to insinuate that anyone who disagrees with her MUST be Enty, okay. I enjoy coming to this blog but some things are a little too far.

--I've actually been in a Federal holding cell. The US Marshall Service, despite what you see in films, can be a little clueless. The kid's story smells a bit, but from what I've hear about the LEO practices of DEA branches, they're barely above operating as drug gangs themselves. C'mon, if the most famous "accidental discharge" firing on YouTube is a sworn DEA agent popping himself in the leg, can you doubt they'd leave some kid forgotten in a holding cell?

You said 1) he'd never get a seven figure settlement because of sovereign immunity issues. I responded that there were ways around sovereign immunity and Kara agreed with that (you seem to trust her opinion which is why I'm pointing to it) and disagreed with your assessment and 2) that ANY lawyer in the United States (bold claim to make) when writing a brief article about what happened to this kid for an entertainment blog would have without a doubt mentioned habeas corpus. I disagreed with that assessment--not because I believe Enty is a lawyer, but because it was a non-issue in this case since no one knew the kid was there and he's already been released and both Unknown and Kara agreed with that. Your theoretical "but there COULD have been a habeas claim at some point!" isn't what you originally said. Sorry I didn't read your mind. I genuinely don't care that much about Enty's identity, if your goal in life is to expose who he really is or isn't, great, good for you. He says he began hullacinating due to being held in there, but managed to find meth in the cell?
Should he have been abandoned? No. Is there more to this? I'd bet my salary on it. (But hey, I'm not a lawyer.)
Plus, I highly doubt that any attorney could pass the bar in any jurisdiction that would post the morass of punctuation errors that was "LeeLee"'s last posting.

ReplyDeleteC'mon, now, I have in the last 48 called out bull narrowly on a couple of things, but also offered up what dish I have in the cellar. Madonna has bad skin, and if Ingrid Casares has ever had a nose job, you couldn't tell from when she glared at me for hulking behind Madge. Deborah Bowen has a hot little tush, and Darryl Steinberg is actually a nice guy. And don't ask me about Jobs again because I've hinted about his past as much as I can.
Oh, right, I was going to throw this one out shut up the doubters: remember the massive scandal that was California electrical deregulation? Remember the rolling brownouts? Old drinking buddy of mine was intimately involved with that. Tens, if not hundreds, of billions of dollars in malfeasance. Actual deaths caused. Could get him on the phone right now, if I had to do so.
I could bust the anonymity of this blog so easily, by technical means if not resorting to legal/political connections. Stop pushing my buttons, I don't have that much patience. I'm being nice about this.

A true troll is a person who insults or injects bedlam into a threads that is off-topic. And while I'm not as concerned as B. Profane is as to Enty's legal skills, I don't think it's wrong to question a blogger in his own comments. I've been coming here for years, and the writing has changed drastically. I miss the old style, so when someone else brings it up, that's not trolling to me. It's nostalgia.
Everyone should be required to use an avatar here, so we could learn who to scroll past, and keep our tempers better. There are a few pictures currently that I know to ignore, as I'm sure many, many of you have already scrolled past mine and will never read this. lol

In my 20 yrs in the prisons I was responsible for checking on the condition of all prisoners under my control. At times this was from 1000 prisoners to 5000. That was every day I worked. I had to visually see the prisoner and sign various papers to that effect. I can not see how any one can forget a prisoner. I know it has happened, but it is either the poor training or complete disregard for the rules (laws) that govern all places that hold, detain and imprison people.
ReplyDeleteAll places that are used to hold, detain and imprison people in the US have to have strict polices and procedure in place. These are in addition to rules or codes of conduct for those in charge. If, the DEA doesn't have these things in place then it is time for a Major Change.
In my years with the prisons I was witness to some "Questionable" things that happened, but this was about the FBI.

B. Profane's "I know the law because I've got a friend" stories remind of a running joke in our family regarding my mom's legal expertise. Our theory is that my mom is a 'legal scholar' because she helped my dad study when he was in law school and she raised 2 children who became attorneys.
ReplyDeleteBecause I am a Cali family law attorney, I did take the troll bait and looked at the Perry/Brand disso settlement thread. B's assertion that s/he was correct about 'community property settlement practice' was incorrect. Actually, s/he made an astute observation regarding how an entertainer's income might be calculated. However, the calculations were irrelevant because Brand didn't want to press the issue.
It's funny how up in arms people get when you tell them the truth.

Similarly, "I wish you'd write less about these *#($&#! reality stars" doesn't bother me at all, but "No one wants to read about the Housewives!" gets my goat. And don't start me on some of their math skills...one has to use a calculator to add up her less than $200 worth of commuter vouchers every month...seriously. Ivy league education for BA, MBA and JD and can not add up $200.
