Brian Austin Green Is Suing His Baby Mama


Back in 2000, Brain Austin Green and Vanessa Marcil started dating. I mean they had been on 90210 together and one thing led to another and they started dating. While they were dating, Brian says that Vanessa asked to borrow some money. So, on four separate occasions he lent her $50,000 for a total of $200K. Then she got pregnant with their child. Brian says that the deal was whenever he needed the money he would notify her and she would pay him back. Well, 11 years later and he wants his money back. I guess 2011 was a bad year for BAG because he says he asked Vanessa for the money in November and she said no. She claims it is a gift. Waiting 11 years seems like a really long time to collect on a debt and I don't think he is going to be able to do anything about it. BAG must be really desperate for cash to go after the mother of his child. He has not needed it for a decade, but suddenly now he needs it?

  1. That's what I was thinking... what's going on that NOW you go after the money? Sounds fishy. Of course, maybe he just kept hoping she'd pay up, and got tired of waiting.

    I wonder what it's like, 1) to have the kind of life where you can loan someone 50K and 2) if you did, not need it back immediately. Wow.

  4. Is there a time limit on money borrowed? Wouldn't he need some sort of written and signed contract to prove this. I doubt they were "e-mailing" each other back then!

    Judge Judy would throw this out of court. "Mr. Green, why didn't you ask for the money TEN years ago, or NINE years ago or even EIGHT years ago? Why are you cluttering up my court? It's time for my lunch. Your case is dismissed!" *bangs gavel*

  11. My guess is that he's screwed and the fact that she's not denying it makes me feel bad that he was naive about not putting it in writing. There's a statute of limitations on these civil matters, I think. He's hardly the only one since there are so many such cases in courts and it's always bitter when the pursuants lose due to lack of proof and expired statute...

  14. Who cares how long he waited? I assume this was separate from child support. It was a loan, he's entitled to his money back, and she needs to cough it up. She's lucky he didn't demand interest.

  16. I believe the statute of limitations on loans in California is four years. It is definitely not 12 years. You'd think his attorney would have advised him of this before he started talking about the "loan" to the media.

  17. As sucky as it is, when you lend money to friends or family members, or even your partner, get it in writing if you want to get that money back at some future point. If you don't get it in writing, then you assume you are not going to get it back. It's amazing how family/friends/partners have very short memories when it comes to paying back what they owe you and all of a sudden a loan becomes a "gift". So get it in writing and document it. Assuming everything is as BAG states, then it is pretty shitty of Vanessa to not pay it back, but she is probably not going to. I think it says more about her than it does him.

  21. Megan purchased a 3 million dollar home a few years back. That could have something to do with it. Did Megan ever get paid for that Transformers movie she was fired from? She actually did a month or so of work on that before Bay fired her. What was her salary on that movie? 4, 5 million? Did she have to give that back? I've been wondering that ever since she was fired.

  22. As my significant other says, if you 'loan' family or friends money, you have to do it with the mindset that you aren't going to get the money back. Otherwise, it will just lead to bad relationships and bad feelings. You have to consider it a gift, and if it does get paid back, well that is a bonus.

    I think he's right.

    Conversely I helped out an ex-boyfriend and paid for a lot of stuff for him after he got laid off including moving him and his stuff cross country while we were in the middle of breaking up, then he cheated on me. I too asked for the money back and was told "sorry no I need money I am putting a down payment on a vacation home". I was pretty pissed off and it took me about 10 years to let it go but I have. That ex and I are 'facebook friends' now and he has apologized in general for how he treated me but that's it.

    In other words, dont lend money if you can't afford to not get it back.

    Umm, yes. This is very strange. When someone agrees to pay you back "promptly" and more than a decade passes, I think you should probably see the writing on the wall, BAG.

  24. Something tells me it has less to do with financial necessity and more to do with "sticking it to her". Maybe she's making custody difficult, maybe she is planning a move. I highly doubt this is bc all of the sudden BAG "needs" the money.

  25. I bet BAG and Megan started living big based on her being the "next big thing," and now that she isn't, they're feeling the pinch. She may be working, but I doubt she's earning the big bucks you would've expected based on where she was a couple of years ago.

  26. Something just occurred to me. That's alot of money to loan someone, even if it is your significant other. Did BAG really have that amount of ready cash sitting in the bank somewhere? I wonder if perhaps he had to use a line of credit, or perhaps borrowed the money from someone else (family, parents maybe) to help the girl out at the time. When you are in love you are willing to beg on their behalf. If that is the case, I can see why he waited so long to give her a chance to pay it back.

    But no matter what the circumstances behind it whether it was a gift or a loan is irregardless. If he asked for it back, if she was an ethical person she should give it back. Just because a judge is probably going to decide in her favour doesn't mean she isn't a greedy thoughtless person who took advantage of her partners goodwill.

  29. Who knows what happened? Going out on a limb but maybe he actually cared for her. Maybe he loved her. She needs money (a substantial sum) 4 different times and he forks it over. Perhaps every time he wanted some sort of payment she had a sob story for him. He is the one with the son so I'm thinking she is a perpetual victim sort but I very well could be wrong. Either way, he must have a case if a lawyer took it. Or maybe he's just trying to shame her into working out some sort of pay arrangement. I just think there is some sort of back story here that we simply do not know.
    Wanting his money back does not make him a bad guy.
    Hell, being married to Megan Fox doesn't make him a bad guy.

    And sadly, I think there have actually been two miscarriages in the past year. I believe her husband referenced the first one after she had the second one that he tweeted about (after she left GH a few months ago). Neither of them could be having an easy time of it these days. :(

  32. Wouldn't the loan be from the time the last loan was made not the first? The statute of limitations would take place on the last date??

  35. Yournamehere: That's what I'm thinking. Unless you can prove a judge that there were some arising circumstance that legally "stop" the 4 year countdown, there's not much to do in courts. But celebrities (even E-list ones) are really touchy about their image and sometimes, the shame of being publicly finger-pointed will make them act differently had it stayed quiet.

  38. Just to add a different perspective, I don't understand why this wouldn't have come up and been settled when the separated. What lawyer would execute a child support agreement without at least asking the parties whether there any other items (i.e. a jointly owned house) that need to be settled as well. Two of them, two sets of lawyers and no one asks or mentions anything? Frankly, and this is pure supposition on my part, I think BAG considered the money as child support and, since the child apparantly now lives with him, regrets having to pay twice for the same child.

    Also am I the only one who wonders why VM needed the money in the first place. Wasn't she was working and making decent coin at the time?

  39. I don't think there's laches in a case at law (as opposed to equity), but there is the statute of limitations. OTOH, it is possible that she has done enough to take it out of the statute of limitations, such as admit the debt within the statute. The defense of "gift" is pretty good unless there's some documentary evidence to the contrary. And, of course, the statute of limitations is an affirmative defense, which means that she doesn't have to assert it if she doesn't want to.

  40. exactly snakeoiler I don't see how a statute of limitations is relevant when there is not a contract in place. I don't think that he can defend it as a loan or contractual obligation when there is nothing in writing and there have been no attempt to follow up or notify or collect (by his attorneys for example) in 11 yrs.

    That being said this makes me really sad in my cold yet Niner loving heart, Gina the bitchy cousin of Donna and David Silver, how could this happen to you????

    And hopefully she has turned her life around but seriously girls who are with David Silver/BAG I think know how to party. Which may be why she needed money then. And why he needs money now. I wonder how much Niner residuals are. Probably not enough to support the ridic life he and MF are trying to live despite her not really acting any more these days.
