Lindsay Lohan In Court
Lindsay Lohan has been in court for the past few hours. She is attending a probation violation hearing where the judge will decide if Lindsay violated her probation by skipping alcohol education classes, and if so, if Lindsay should serve some jail time. During the hearing the judge decided not to listen to any testimony or proof that Lindsay was drinking after the MTV Movie Awards. The judge said she was allowed to drink during her probation and the no drinking order was about bail, and not about her probation.
At this point, the owners of the alcohol class are saying that because the judge did not give them a written order they let Lindsay miss classes. It did not matter they talked to the judge on the phone. I don't know what Lindsay did for these people but they basically are saying they ignored the judge for Lindsay. WTF?
The good news is that while Lindsay was headed to court she got served with another lawsuit dealing with the $17,000 in shoes she bought but did not pay for.
Oh, and Michael Lohan was told to shut up and if he wanted to make a statement it should be in writing.
My bet is that she'll get off (again) but oh, would I love to see her do some time!

The drinking during probation thing makes zero sense to me. Can any readers who are lawyer-type people please explain?

ReplyDeleteI'm watching this on TRU t.v. and the judge just looks exasperated by the whole thing. It's pretty funny. The treatment center director actually tried not to testify and answer any of the Prosecutor's questions - probably because the director didn't comply with the orders given on the phone call like Enty said. I didn't get the part about being allowed to drink on probation...? I don't understand this either.
ReplyDeleteFrom my understanding, not drinking was a condition of her bail. When the SCRAM went off bail was revoked. They just paid the higher amount, and Lindsay continued to do whatever the hell she wanted.

Speaking of which, I've lost all respect for Gloria these days with her representation of the Tiger Wood's whore. It used to be she'd rep the "little person" who'd been wronged by the big bad employer,etc, but now she reps anyone/any whore with a checkbook. I bet the real reason Lisa Bloom moved to the LA area is to take over Mommy's law firm when ol' Gloria retires. By the looks of it she's off to a good start considering she's reping Michael Lohan the biggest scumbag around.

ReplyDeleteThis AM TMZ ran old video showing the judge saying not once, but twice, that Lilo was NOT to drink. So why is it suddenly not a condition of Lilo's probation or bail? As previously stated by another poster then why impose the SCRAM device if the court's not going to stand by its previous ruling??!! Bet the DA is pissed she can't show the court her evidence of Lilo's drinking at the MTV awards.

ReplyDeleteIn Oregon, the only way a person can be restricted from drinking while on probation is if it is made a special condition of probation.
Special conditions of probation can only be imposed where there is evidence adduced at trial regarding alcohol abuse or if the charges involve the use of alcohol.
So, if you have a trespass or driving while suspended - no no alcohol clause. If you have a DUII, there's an alcohol clause. BUT - technically, if it's a DUII for something like pot, then there is no reason to suspect a drinking problem. What kind of DUI did she plead to? Maybe it's not standard in CA? Maybe it was left out as an oversight?
If it's not in the sentence or judgment order, then the order needs to be modified before it can really be enforced against her. The judge can't just say one thing and write something different in the order.
And yes, there is a difference between the conditions of her release (bail is a security release, she paid money rather than stay in jail) and the conditions of probation (which she is on regardless of whether she is sitting in jail or free).

ReplyDeletewhat's lindsay done with her career that makes her so fucking special that the state of california will continue to just roll over and play dead for her. what are the laws in place for, what's the point of arresting her, that's the point of her probation if she can get away damn near with murder, repeatedly and still not see a day in jail?
ReplyDeletewhat is the state telling the rest of the world? she's not even a famous actress. she hasn't worked in years. a famous loser? sure. but she's not worth this kind of protection and special treatment.
I don't know why the court is wasting so much time today. She obviously didn't comply with he terms of her probation. Violate her for not attending the required classes, stick her in jail for a few days to show her you are serious and then extend the probation and alcohol classes. Seems like a no brainer to me.

ReplyDeleteI hope something helps her as I am not anti-human as much as I hate her entitlement. Jail, rehab, anything. Otherwise, we'll think about her as much as Anna Nicole Smith, that Casey chick that didn't OD but could well have and Brittany Murphy. All but forgotten.
I have no confidence whatsoever that she will have any real punishment metered out to her.

enty, the judge did NOT say it was ok for her to drink while on probation. she simply didn't want to take up the SCRAM bracelet issue today because she had told the defense liar it was a bail issue---and wouldn't be dealt with now.
ReplyDeletethe prosecutor wanted to do it today but since the defense liar hadn't had time to get her witnesses lined up to deal with the SCRAM going off, she gave her a break.
total misreading of what the judge said, which surprises me coming from an attorney.

ReplyDeletealso, there was an issue about it not being specifically WRITTEN in that she was NOT to drink. plus by the time they got to her, she tested clean. i'm not sure if this was the order with the scram, or the original order after the first dui bust. technicality.
