90 Days?


In one of the most shocking verdicts I have ever seen, Wynona Judd's ex husband was sentenced to 90 days in jail after he plead guilty to two felony counts of attempted sexual battery against a minor. The minor in question was 13 years old and Dan Roach was 51. All he got was 90 damn days? That's it? And this was in Tennessee. I thought Tennessee would be a state that would frown on that kind of behavior but I guess not.

Yes, he got ten years of probation and if he violates it he will do the whole ten years, but 90 days? People spend more time in jail for bouncing a couple of checks. So, for all the 13 year old girl went through. All the dreams she is going to have for the rest of the life, she can be comforted by the fact that this sex pervert ass got 90 days in jail for ruining her life.

How in the hell does this happen? I'm also pissed at Wynona. She says that she was shocked that her husband would ever do such a thing. I hope she would be, but I don't know where the hell her outrage is. It wasn't evident last year when she was interviewed and said she still wears her wedding ring and was having a tough time letting go. To me that says that she is an idiot and that she has some sever problems she needs to address. What if they had kids? Would she still be having trouble letting go if he had done the same thing to their daughter.

There are very few people I dislike more than Ashley Judd but I bet she had no problems calling this ass exactly what he is. 90 days? If judges are elected in Tennessee, someone needs to vote this judge off the bench.

    legally, I mean -- is that code for trying to rape her? or is it lewd comments? I mean I know it all means that he is a huge scummy dirtbag, but I am a bit confused

    According to Tennessee law, sexual battery is unlawful sexual contact with a victim by the defendant or the defendant by a victim accompanied by any of the following circumstances:

    • Force or coercion is used to accomplish the act;
    • The sexual contact is accomplished without the consent of the victim and the defendant knows or has reason to know at the time of the contact that the victim did not consent;
    • The defendant knows or has reason to know that the victim is mentally defective, mentally incapacitated or physically helpless; or
    • The sexual contact is accomplished by fraud. Tenn. Code Ann. § 39-13-505 (2007).

    Coercion means the threat of kidnapping, extortion, force or violence to be performed immediately or in the future. Sexual battery is a Class E felony.

  5. I don't know about there, but here sentences like that are standard for first timers. Mostly because who wants to put the 13 year old through that? And, of course, the sentence is with the victim and family's consent.

    What they do is impose really, really strict conditions of probation that most people would mess up on. As soon as the person messes up - boom - 10 years in prison without ever making the poor girl testify. If, by some miracle, the person can actually make it through probation without messing up, then maybe the allegations were truly an aberration on his part.

    What is wrong with Wynona having a hard time to letting go. The guy is a pedophilla (misspell) cut his balls off.

    I think I would have a hard time finding out something as awful as this about ones spouse but wouldn't have a problem kicking him out and making sure he wasn't in my will.

  11. In Oregon, we call it a "conditional downward departure".

    And by the way, no matter what the maximum sentence that statute SAYS it is - you can't give anything more than what the sentencing guidelines say (often probation instead of jail) without very specific guidelines being met under a US Supreme Court decision called Blakely v. Washington.

  13. its a plea bargain so both sides agreed to it. by 'both sides' i mean the defense and the STATE. the state is the 'victim' in a criminal case, not the person victimized.
    plea bargains are done all the time that are not just fine with the victim, and in many cases, the victim's not even consulted about it. i know this from personal experience. the DA told me the state has no obligation to clear a plea deal with a crime victim before offering one and making the deal. just so you know.

  14. when Ashley went to college in my hometown at Univ of Ky -- she was like a normal sorority girl ... i knew girls who were sisters with her ... and my mom actually audited a class with her and was "friends" with her ... but maybe she's become a b*tch since getting Hollywoodized

  15. Actually, again - it depends on the state. In Oregon, victims have a constitutional right to be consulted about any plea by the DA and have to be contacted before any plea bargain is accepted by the judge. If the DA fails to do so, the victim can sue the DA's office.

    Just saying, we don't know why he got 90 days but it could very well be a way to get the conviction, put significant restrictions on him that will land him in prison if he can't totally straighten out, and not further victimize the victim.

  18. The problem with giving someone strict probation knowing that they will screw it up is that in these cases the "screw ups" affects a childs life. You always hear of kids getting raped and killed by someone who got a lienent sentence the first time. This is usually a pattern of behavior and probation doesn't usually stop it.

  20. I have met Ashley in Daytona, and I must say that she was nothing but kind and down to earth.
    I met her in a circumstance to where she could have been bitchy and everyone would have kind of expected it, but she WAS just down to earth like regular folk. Kind of nice if you want to know the truth, and I can smell snark a mile away. That is why I was asking..

  21. There was an incident recently in a suburb of Montreal. Guy at a park bench unzipped his pants, called the kids over to look what he had and invited them to touch him. Horrified, they backed off and one child ran to a man who was passing by. He came over, saw what the perv was up to, beat the shit out of him then told the kids to call the cops. Cops found the pedophile on the ground with his pants around his ankles and a badly beaten face. He was on probation for the same thing and they found child pornography on his premises.

    The police are "looking" for the person who beat him.

  25. Nashvillians have long loathed Ashley because she was a brat growing up. Can't speak to what she's like now.

    But I will defend my sisterfriend, Wynonna. Lay off her, will ya? I mean, she had Naomi Judd as a mother, someone who LIED TO HER until she was in her 20s about who her real father was!!! (If you want to hate someone, hate Naomi! She's a lying b*tch.)

    Did you know that Wy's ex was in rehab when he was arrested? So it looks like he was trying to get help for whatever his problems are. That's likely why he got a plea deal.

    Throwing someone in prison for a crime like this DOESN'T make the BEHAVIOR go away. I hope and pray that he continues treatment and doesn't victimize anyone else.
