Judge Rejects Chris Brown Case Dismissal

With Chris Brown still on a multi-day trip to Washington D.C., his attorney, Mark Geragos appeared in court on his behalf yesterday and was shot down by the judge handling the case. Geragos had asked the judge to dismiss the misdemeanor assault case against Brown because prosecutors had abused the grand jury process to "freeze" the testimony of the victim in the case.

The judge said there was no abuse and ordered the case to move forward. The trial is set to begin next Thursday and will be decided by the judge, rather than a jury because it is just a misdemeanor. Not having a jury hearing the case is probably the reason a deal will get made between prosecutors and Brown. The thing is, if Brown is convicted or pleads guilty to any crime he is going to face prison back here in California for violating his probation. The judge here has already shown how much they dislike Brown by putting him on this never ending trip to D.C., and there is no doubt a jail cell will be waiting for Brown if he gets convicted. I'm sure Brown would love to write a big fat check to the defendant to make this all go away. That would happen if it was a California case, but I don't think it is going to happen in D.C.

Sometimes karma takes a little longer than we'd like, but it always gets its jobs done.

He should start bunghole stretching exercises now, so it isn't a shock to his system.

Unfortunately Count he will probably buy some muscle and get left alone with the hope that they can join his posse or hang with him a little when they get out. Jailhouse celeb.

@Texas: Dude has no self control. If he is in gen pop, he's gonna get lippy and shanked. You know damn well other inmates are going to be baiting him, talking about Rihanna and smacking her around.

given rihanna penchant for pegging and his violent homophobia I'm sure he's well prepared. I'm thrilled that his feet are being held to the fire in this manner.

Anna, good to see you.

How is there no jury? Are they not seeking jail time?

Gotta agree with the E. If this went down in Cali, Chris Brown would be at In N Out right now, celebrating his freedom with a double-double, Animal style.

Nevertheless, I'm simply heartbroken. :D

SEVEN, what is happening to Loki in that? Is he getting a Hawkeye handy or taking an Iron Dump?

They're treating this more like a probation violation and since it's only a misdemeanor it will only go through the judge. Chris claims Piru/Blood so he will have connections when he inevitably gets locked up, but it will cost him a pretty penny. And come on Enty, you should know that CB will more likely end up in JAIL, not prison. Big difference.

@Kara: You don't get juries for misdemeanors, only felonies. They aren't going to waste the time and money to convene a jury for everybody who got in a fight or DUI or CDS possession.

He would have been far better off had he admitted to what beating Rihanna & getting a real sentencing than what's happening now.

We can only hope the same happens to Bieber soon & a real judge takes an instant dislike to that turd.

Misdemeanors trials get juries in Oregon. I didn't realize that there were states that wouldn't give jury trials on anything that you could get jail time on. Then again, I don't know why we have the 6 mo distinction still when it was clearly thrown out re: right to counsel in Gideon.

But who am I to judge the Supreme Court?

This comment made me smile

@Kara: That is crazy. Maybe there isn't enough crime in Oregon to keep the courts busy? If every DUI in NJ had to have a jury, our courts would come to a standstill or our property taxes would skyrocket to cover the extra staff. Much less every dipshit caught with a doobie.

Remember, kids: It's not OK to abuse a grand jury process, but it's A-OK to abuse your girlfriend and anybody that crosses your path!

Would it sound glib if I simply suggest that he stop hitting people?
Just walk away, Chris, or use your words (sans threats) to explain why you're upset.
Having said that…
I think it'll be the interminable Con Air ride with US Marshals, who're impressed by No One that'll really be the punishment for him.
